Statutory disclosure duty according to article 13 and 14 GDPR

According to article 13 of the (EU) 2016/679 Regulation (General Data Protection Regulation, GDPR) we are obliged to state how we collect, use and safeguard your personal data. PURPOSE OF DATA PROCESSING, LEGITIMACY AND CATEGORIES OF PERSONAL DATA BEING PROCESSED 

If you get in contact or have business relations with us either as principal or supplier, we will process the following data:

  • form of adress, first name, surname,
  • email address,
  • company name,
  • job function,
  • address, phone numbers,
  • contractual data on orders received or given,
  • bank accounts,
  • other personal data we require to fulfil our contractual obligations with our clients

Data is processed for the following purposes, depending on the reason for its provision:

  • for the purpose of and within balancing of interests (art. 6(1f) GDPR). Processing of your personal data, if necessary, to ensure our third parties’ legitimate interests
  • Examples:
    • consultation and other communication
    • shipping of information of our products and services
    • manufacturing and distributing of battery cans in the context of contract performance with
    • our customers and suppliers () or performing pre-contractual activities
    • asserting legal rights and defending in case of legal disputes
    • guaranteeing the companies’ IT safety and IT reliability
    • preventing and investigating of criminal offences
    • video surveillance safeguarding domiciliary rights and collecting evidence in case of burglaries
    • property damage (third parties also)
    • activities regarding building and plant safety (e.g. access control)
    • activities safeguarding domiciliary rights
    • activities managing business and further development of products and services
    • managing risks within the H&T Group
  • by given consent (art. 6(1a) GDPR)

As far as you have given us your consent to process personal data for one or more specific purposes, the lawfulness of the processing is given by your consent. Given consent can be revoked at any time. This also applies for declarations of consent, issued to us before GDPR became effective (before May 25, 2018). Lawfulness of data processed before the withdrawal is not affected by the withdrawal.

  • on the basis of compliance with a legal obligation (art. 6(1c) GDPR) or in public interest (art. 6(1e) GDPR)
  • performing of a contract (art. 6(1b) GDPR)

RECIPIENT OF YOUR PERSONAL DATA

Personal data will be sent to the following entities (processors), where processing is to be carried out on behalf of H&T Marsberg according to art. 28 GDPR:

  • To Heitkamp & Thumann companies providing IT services
  • To Heitkamp & Thumann companies collaborating with us as part of order processing

DURATION OF DATA PROCESSING

Personal data being saved due to statutory storage obligations will be deleted as soon as this is lapse. Apart from that personal data will be preserved as long as the purpose of processing exists. Data that is saved due to a consent of the data subject according to art. 6(1a) GDPR will be deleted as soon as the purpose of processing is no longer applicable or the consent is revoked.

SOURCES, FROM WHICH YOUR PERSONAL DATA ORIGINATES

Insofar as we have not collected your personal data directly from you, the data derives from the following sources:

  • Public register, pubilcations in the internet, address trading, recommendations from third parties.

YOUR RIGHTS / RIGHT TO APPEAL

Any person who provides us with their data has the right to:

  • withdraw his or her consent to the processing of personal data according to art. 7(3) GDPR. As a consequence, we are obliged to refrain from processing data, affected by the consent. Lawfulness of data processed before the withdrawal is not affected by the withdrawal.
  • obtain from H&T Marsberg confirmation as to whether or not personal data concerning him or her are being processed according to art. 15 GDPR. Where that is the case, the right to access to the personal data and the following information: purposes of the processing, categories of personal data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed, the envisaged period for which the personal data will be stored, the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data, the right to lodge a complaint, where the personal data are not collected from the data subject, any available informatio as to their source and the existence of automated decision-making, including profiling and at least in those cases, meaningful information about the logic involved.
  • request the rectification of inaccurate data or completion of your stored data with us according to art. 16 GDPR.
  • request the deletion of your personal data according to art. 17 GDPR when it is no longer necessary for the purposes for which it was collected or as far as the processing is not necessary to exercise the freedom of speech, communication and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend of legal claims.
  • restriction of processing according to art. 18 GDPR, where one of the following applies:
    • the accuracy of the personal data is contested by him or her, for a period enabling the controller to verify the accuracy of the personal data.
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
  • we no longer need the personal data for the purposes of the processing, but they are required by him or her for the establishment, exercise or defense of legal claims.
  • he or she has objected to processing according to art. 21(1) GDPR pending the verification whether the legitimate grounds of the controller override his or hers.
  • receive the personal data concerning him or her, which he or she has provided to us in a structured, commonly used and machine-readable format and to transmit those data to another controller without hindrance from the controller to which the personal data have been provided according to art. 20 GDPR.
  • to lodge a complaint with a supervisory authority according to art. 77 GDPR, in the event of breach of your rights regarding the processing of personal data.

PROVISION OF YOU PERSONAL DATA

The provision of personal is usually not necessary for the fulfilment of our contractually owed services to our Suppliers and clients. The storage of contact persons and their contact data contributes to a fast and efficient communication with you.

RIGHT OF OBJECTION

You have the right to object against the processing of your personal data pursuant to art. 21 GDPR, as far as your personal data is processed on the basis of a legitimate interest in accordance with art. 6(1f) GDPR and there are reasons for this which arise from your particular situation.
